Its purpose is to make sure the insurer compensates losses arising during transport from cargo loss, damage, or destruction caused by circumstances outside the carrier's control.
There is still a widespread belief among cargo owners that the carrier is always responsible for the cargo's safety throughout transport and must reimburse the full cost of any loss. In reality, a transport document and a cargo insurance contract are not the same thing. While a transport document serves as a guarantee of compensation for damage to the cargo, freight transport is governed by transport legislation — both national and international, such as the CMR convention — which clearly defines the limits of the carrier's liability. Situations of force majeure, where circumstances are beyond anyone's control, are also covered, and in those cases the carrier is fully released from liability.
